১. সংজ্ঞাসমূহ

যেকোনো ব্যক্তি বা প্রতিষ্ঠান, যারা আমাদের ওয়েবসাইট ব্যবহার করেন, অ্যাকাউন্ট নিবন্ধন করেন, অর্ডার প্রদান করেন অথবা আমাদের কোনো ডিজিটাল পণ্য বা সেবা গ্রহণ করেন।

১.৪ ডিজিটাল পণ্য

Gift Card, License Key, Game Key, Game Top-up, Subscription, Software License, Digital Code, Utility Service (যেমন Bill Payment, Mobile Recharge) এবং ইলেকট্রনিকভাবে সরবরাহযোগ্য অন্যান্য ডিজিটাল পণ্য ও সেবাকে বোঝানো হয়েছে।

১.৫ সেবা

Gift Cards Zone BD-এর মাধ্যমে প্রদানকৃত সকল ডিজিটাল পণ্য, সাবস্ক্রিপশন, টপ-আপ, লাইসেন্স, কোড, অ্যাকাউন্ট, Utility Service এবং Customer Support-কে বোঝানো হয়েছে।

১.৬ অর্ডার

গ্রাহকের দ্বারা ওয়েবসাইটের মাধ্যমে প্রদত্ত যেকোনো ক্রয় অনুরোধ, যা সফল পেমেন্টের পর প্রক্রিয়াকরণ করা হয়।

১.৭ ডেলিভারি

ডিজিটাল কোড, লাইসেন্স, টপ-আপ, অ্যাকাউন্ট, সাবস্ক্রিপশন অথবা অন্যান্য ডিজিটাল সেবা গ্রাহকের Dashboard, Email, WhatsApp, API অথবা নির্ধারিত অন্য কোনো মাধ্যমে সফলভাবে সরবরাহ করাকে বোঝানো হয়েছে।

১.৮ শেয়ার্ড অ্যাকাউন্ট

এমন ডিজিটাল অ্যাকাউন্ট যা একাধিক ব্যবহারকারীর ব্যবহারের জন্য নির্ধারিত এবং যার ব্যবহার সংশ্লিষ্ট পণ্যের শর্তাবলী দ্বারা নিয়ন্ত্রিত।

১.৯ তৃতীয় পক্ষের সেবা প্রদানকারী (Third-Party Provider)

যে কোনো প্রতিষ্ঠান, প্ল্যাটফর্ম বা সেবা প্রদানকারী, যার মাধ্যমে Gift Cards Zone BD গ্রাহকদের ডিজিটাল পণ্য বা সেবা প্রদান করে।

১.১০ নীতিমালা

এই Terms & Conditions, Privacy Policy, Delivery, Refund, Return & Exchange Policy এবং ওয়েবসাইটে প্রকাশিত অন্যান্য নীতিমালাকে বোঝানো হয়েছে।

২. ওয়েবসাইট ব্যবহার

২.১ যোগ্যতা

  • সঠিক তথ্য প্রদান করা গ্রাহকের দায়িত্ব।
  • Account, Password ও OTP-এর নিরাপত্তা সম্পূর্ণ গ্রাহকের দায়িত্ব।
  • অ্যাকাউন্টের মাধ্যমে সংঘটিত সকল কার্যক্রমের জন্য গ্রাহক দায়ী থাকবেন।

২.৩ নিষিদ্ধ কার্যক্রম

নিম্নোক্ত কার্যক্রম কঠোরভাবে নিষিদ্ধ—

  • ভুয়া তথ্য ব্যবহার করা।
  • প্রতারণামূলক পেমেন্ট করা।
  • অনুমতি ছাড়া ডিজিটাল পণ্য পুনঃবিক্রয় বা বিতরণ করা।
  • Bot, Script বা Automation Tool ব্যবহার করা।
  • শেয়ার্ড অ্যাকাউন্টের নিয়ম লঙ্ঘন করা।
  • কর্মীদের প্রতি অপমানজনক, হুমকিমূলক বা অশোভন আচরণ করা।

প্রয়োজনে কোম্পানি পূর্ব নোটিশ ছাড়াই অ্যাকাউন্ট স্থগিত, সীমিত বা বাতিল করতে পারে।

৩. পণ্য ও সেবা

৩.১ প্রাপ্যতা

সমস্ত ডিজিটাল পণ্য ও সেবা স্টক, তৃতীয় পক্ষের প্রাপ্যতা এবং প্রযুক্তিগত সক্ষমতার উপর নির্ভরশীল।

৩.২ মূল্য

পণ্যের মূল্য, অফার বা ডিসকাউন্ট পূর্ব নোটিশ ছাড়াই পরিবর্তন হতে পারে।

৩.৩ ডেলিভারি

  • অধিকাংশ অর্ডার Instant ডেলিভারি করা হয়।
  • কিছু ক্ষেত্রে ডেলিভারিতে ২–৫ মিনিট সময় লাগতে পারে।
  • বিশেষ পরিস্থিতিতে (পেমেন্ট যাচাইকরণ, স্টক সমস্যা, তৃতীয় পক্ষের বিলম্ব বা প্রযুক্তিগত জটিলতা) ডেলিভারিতে সর্বোচ্চ ২৪ ঘণ্টা পর্যন্ত সময় লাগতে পারে।

৩.৪ রিফান্ড

রিফান্ড, রিটার্ন ও এক্সচেঞ্জ আমাদের Delivery, Refund, Return & Exchange Policy অনুযায়ী পরিচালিত হবে।

৩.৫ সাপোর্ট সময়

Customer Support প্রতিদিন সকাল ১০:০০টা (10:00 AM) থেকে রাত ১০:০০টা (10:00 PM) পর্যন্ত উপলব্ধ।

৪. মেধাস্বত্ব

ওয়েবসাইটের সকল লেখা, ডিজাইন, ছবি, লোগো ও কনটেন্ট Gift Cards Zone BD-এর সম্পত্তি অথবা বৈধভাবে ব্যবহৃত উপাদান।

তৃতীয় পক্ষের Logo, Trademark ও Brand Name সংশ্লিষ্ট মালিকদের সম্পত্তি এবং শুধুমাত্র পণ্য শনাক্তকরণের উদ্দেশ্যে ব্যবহৃত হয়।

৫. শেয়ার্ড অ্যাকাউন্ট

যেসব পণ্য Shared Account হিসেবে বিক্রি করা হয়—

  • শুধুমাত্র ব্যক্তিগত ব্যবহারের জন্য।
  • Password, Recovery Email অথবা Security Settings পরিবর্তন করা যাবে না (যদি অনুমতি না থাকে)।
  • অনুমতি ছাড়া অন্যের সাথে শেয়ার বা পুনঃবিক্রয় করা যাবে না।
  • নীতিমালা লঙ্ঘন করলে Support ও Warranty বাতিল হতে পারে।

৬. ওয়ারেন্টি

যেসব পণ্যের বিবরণে Warranty উল্লেখ থাকবে, শুধুমাত্র সেসব পণ্যের ক্ষেত্রেই Warranty প্রযোজ্য হবে।

গ্রাহকের ভুল ব্যবহার, ডিভাইসজনিত সমস্যা অথবা Third-Party Provider-এর নীতিমালা পরিবর্তনের কারণে সৃষ্ট সমস্যার ক্ষেত্রে Warranty প্রযোজ্য হবে না।

৭. দায়বদ্ধতার সীমাবদ্ধতা

Gift Cards Zone BD একটি অনুমোদিত রিসেলার বা মধ্যস্থতাকারী হিসেবে কাজ করে।

Third-Party Provider-এর নীতিমালা পরিবর্তন, Server Down, API Failure, Account Suspension, মূল্য পরিবর্তন অথবা পরিষেবা বন্ধ হয়ে যাওয়ার কারণে সৃষ্ট ক্ষতির জন্য কোম্পানি দায়ী থাকবে না।

৮. Force Majeure

প্রাকৃতিক দুর্যোগ, যুদ্ধ, ইন্টারনেট বিভ্রাট, বিদ্যুৎ সমস্যা, ব্যাংকিং বা পেমেন্ট সিস্টেমের ত্রুটি, API ব্যর্থতা, সরকারি বিধিনিষেধ অথবা কোম্পানির নিয়ন্ত্রণের বাইরে থাকা অন্য কোনো কারণে সেবা বিলম্বিত বা ব্যাহত হলে কোম্পানি দায়ী থাকবে না।

৯. নীতিমালার পরিবর্তন

Gift Cards Zone BD যেকোনো সময় পূর্ব নোটিশ ছাড়াই এই শর্তাবলী সংশোধন, পরিবর্তন বা হালনাগাদ করার অধিকার সংরক্ষণ করে। সংশোধিত নীতিমালা ওয়েবসাইটে প্রকাশের পর থেকেই কার্যকর হবে।

১০. প্রযোজ্য আইন

"Policies" refer to these Terms and Conditions, the Privacy Policy, the Delivery, Refund, Return & Exchange Policy, and any other policies published on our website.

2. Website Usage

2.1 Eligibility

  • Engaging in abusive, threatening, or inappropriate behavior toward our employees or support staff.

Gift Cards Zone BD reserves the right to suspend, restrict, or terminate any account without prior notice if these Terms are violated.

3. Products and Services

3.1 Availability

All digital products and services are subject to stock availability, third-party availability, and technical limitations.

3.2 Pricing

Product prices, promotions, and discounts may be changed at any time without prior notice.

3.3 Delivery

  • Most orders are delivered instantly.
  • In some cases, delivery may take 2–5 minutes.
  • Under special circumstances, including payment verification, stock shortages, third-party delays, or technical issues, delivery may take up to 24 hours.

3.4 Refunds

Refunds, Returns, and Exchanges are governed by our Delivery, Refund, Return & Exchange Policy.

3.5 Support Hours

4. Intellectual Property

  • Violation of these rules may result in the cancellation of support and warranty.

6. Warranty

Warranty does not apply to issues resulting from customer misuse, customer devices, or changes made by Third-Party Service Providers.

7. Limitation of Liability

We shall not be liable for any losses or damages arising from changes in Third-Party Service Provider policies, server downtime, API failures, account suspensions, pricing changes, or service discontinuation by third-party providers.

8. Force Majeure

Gift Cards Zone BD shall not be held responsible for delays or failures in providing services due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, internet outages, power failures, banking or payment system failures, API failures, government actions, or other unforeseen events.

9. Changes to These Terms

Gift Cards Zone BD reserves the right to modify, update, or revise these Terms and Conditions at any time without prior notice. Any changes become effective immediately upon publication on our website.

10. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Bangladesh. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of Bangladesh.
